Direito à educação básica nos primeiros anos do ensino fundamental de imigrantes haitianos de Campinas/SP (2018 a 2021)

Abstract

Um terremoto em 2.010 desencadeou uma enorme crise humanitária no Haiti, um dos países mais pobres do mundo, obrigando sua população a buscar melhores condições de vida em outros países como o Brasil. Estima-se oficialmente que entre 2.012 e 2.019, cerca de 106,1 mil haitianos desembarcaram no Brasil e 900 deles migraram para o município de Campinas. De acordo com o ordenamento jurídico nacional (Lei de Migração nº 13.445/17) e tratados internacionais ratificados pelo Brasil, os imigrantes possuem um conjunto de direitos humanos fundamentais, incluindo o direito à educação básica. O objetivo do presente trabalho é analisar o (des)compasso entre o direito do imigrante à educação básica nos primeiros anos do ensino fundamental e as políticas públicas desenvolvidas pelo município de Campinas. Utiliza pesquisa documental e bibliográfica, para delimitar o conteúdo normativo do direito à educação básica (dever ser), com base no ordenamento jurídico internacional, e, internamente, por meio do estudo da Constituição Federal, das leis federais, leis do Estado de São Paulo e da Legislação Municipal de Campinas/SP. Com base nesse conjunto normativo, afere, então, se as políticas públicas do município garantem o acesso dos imigrantes haitianos nas escolas, investigando especificamente se este direito está sendo promovido e resguardado pela administração pública municipal. Como resultado, a pesquisa demonstra o descompasso entre os documentos normativos internacionais, constitucionais, supralegais, federais, estaduais e municipais investigados, e a forma como as políticas públicas municipais, que deveriam garantir este direito, são implementadas no município. Apesar da garantia do direito à educação básica, os haitianos que migraram para Campinas, por conta da carencia de políticas publicas especificas voltadas para a inclusão deste povo, apesar de acessarem efetivamente em termos quantitativos, a escola, há descompasso em termos qualitativos por conta da dificuldade de compreensão do ensino ofertado em sala de aula. A pesquisa contribui para as investigações desenvolvidas na linha de Cooperação Internacional e Direitos Humanos, pelo Grupo de Pesquisa “Direito em um mundo globalizado”, especificamente, com as pesquisas realizadas pelo professor orientador, na área da educação e da democracia no continente americano.

An earthquake in 2010 triggered a huge humanitarian crisis in Haiti, one of the poorest countries in the world, forcing its population to seek better living conditions in other countries such as Brazil. It is officially estimated that between 2012 and 2019, about 106,100 Haitians landed in Brazil and 900 of them migrated to the municipality of Campinas. According to the national legal system (Migration Law nº 13.445/17) and international treaties ratified by Brazil, immigrants have a set of fundamental human rights, including the right to basic education. The objective of the present work is to analyze the (mis)compass between the immigrant's right to basic education in the first years of elementary school and the public policies developed by the municipality of Campinas. It uses documentary and bibliographic research to delimit the normative content of the right to basic education (must be), based on the international legal system, and, internally, through the study of the Federal Constitution, federal laws, laws of the State of São Paulo and the Municipal Legislation of Campinas/SP. Based on this set of regulations, it then assesses whether the municipality's public policies guarantee the access of Haitian immigrants to schools, specifically investigating whether this right is being promoted and protected by the municipal public administration. As a result, the research demonstrates the mismatch between the international, constitutional, supra-legal, federal, state and municipal normative documents investigated, and the way in which municipal public policies, which should guarantee this right, are implemented in the municipality. Despite the guarantee of the right to basic education, the Haitians who migrated to Campinas, due to the lack of specific public policies aimed at the inclusion of this people, despite effectively accessing the school in quantitative terms, there is a mismatch in qualitative terms due to the difficulty in understanding the teaching offered in the classroom. The research contributes to the investigations carried out in the line of International Cooperation and Human Rights, by the Research Group “Law in a globalized world”, specifically, with the research carried out by the guiding professor, in the area of education and democracy in the American continent.
