Operações urbanas consorciadas em São Paulo aplicação do instrumento em diferentes contextos

Abstract

A tese versa sobre as Operações Urbanas Consorciadas (OUCs) como instrumento de planejamento, produção e gestão democrática do espaço urbano, tendo como parâmetros exemplos estrangeiros de grandes projetos urbanos e as OUCs atualmente vigentes na cidade de São Paulo atrelados aos seus diferentes contextos político-institucionais, econômico-financeiros e territoriais. Considerando as possíveis inovações trazidas ao modelo pela OUC Bairros do Tamanduateí – atualmente um Projeto de Lei em análise na Câmara Municipal – nos perguntamos se e como essa nova OUC pode interferir na contradição dada, por um lado, pela lógica dos mercados imobiliário e financeiro imanente à produção do espaço urbano e, por outro, pela garantia do direito à cidade estabelecida pelo Estatuto da Cidade e reforçada pelo Plano Diretor Estratégico de 2014 diferenciando-se, assim, de suas congêneres e proporcionando resultados condizentes com seus objetivos e diretrizes.

This thesis examines Urban Operations in Consortium (OUCs) as a tool for planning, production and democratic governance of urban space, taking all the valid OUCs in São Paulo (Brazil) up to date as the object of research with the ongoing discussion about possible innovations brought to the model by the new OUC Bairros do Tamanduateí currently in analysis by Câmara Municipal de São Paulo (The Town Hall). Considering these innovations and the different political, institutional, economic and territorial contexts, we have asked how OUC Bairros do Tamanduateí may interfere in the contradiction between, on one hand, by the logics of financial and real estate markets immanent to the production of urban space and, on the other, by the warranty of the right to the city established by Estatuto da Cidade (the City Act) reinforced by the 2014´s São Paulo Master Plan, being differentiated from the previous ones and generating outputs befitting to its objectives.
