Uma análise sobre o nascimento do constitucionalismo multinível e sua proteção desempenhada nos direitos humanos dentro do sistema interamericano frente a soberania estatal dos estados membros

Abstract

A presente pesquisa tem o objetivo de abordar o cenário mundial atual, no qual com o fenômeno da globalização se fez necessário o surgimento de novos modelos jurídicos para responder problemas transfronteiriços. Logo, a pesquisa traz a reflexão sobre o exercício contemporâneo da soberania estatal diante da tutela dos direitos humanos na esfera internacional, colocando em pauta uma nova soberania focada na dignidade da pessoa humana e admitindo limites do Estado a partir da ótica da humanidade. Realiza-se uma análise do constitucionalismo multinível observada no Sistema Europeu de Direitos Humanos, propondo-se a perquirir a aproximação desses panoramas em relação ao Sistema Interamericano de Direitos Humanos, dessa forma, alude casos de ambos os sistemas. Ademais, identifica-se nessas organizações a necessidade de um diálogo, cooperação e pluralidade, que vai além da segurança jurídica e atinge o respeito, proteção e efetivação dos direitos humanos através de instrumentos como o princípio pro persona e controle de convencionalidade. Por fim, elucida que aproteção multinível dos direitos humanos reafirma o conceito contemporâneo da própria constituição, que partem de princípios consagrados no âmbito internacional, tal como consolida a soberania estatal com a vontade popular de ter resguardados liberdades e garantias fundamentais em diferentes níveis interdependentes e que conversam entre si.

The present research aims to address the current world scenario, in which the phenomenon of globalization made it necessary to create new legal models to respond to cross-border problems. Therefore, the research brings a reflection on the contemporary exercise of state sovereignty in the face of the protection of human rights in the international sphere, putting on the agenda a new sovereignty focused on the dignity of the human person and admitting limits of the State from the perspective of humanity. An analysis of the multilevel constitutionalism observed in the European System of Human Rights is carried out, proposing to investigate the approximation of these panoramas in relation to the Inter-American System of Human Rights, in this way, it alludes to cases of both systems. Furthermore, it is identified in these organizations the need for a dialogue, cooperation and plurality, which goes beyond legal certainty and reaches respect, protection and realization of human rights through instruments such as the pro persona principle and conventionality control. Finally, it clarifies that the multilevel protection of human rights reaffirms the contemporary concept of the constitution itself, which is based on principles enshrined at the international level, as it consolidates state sovereignty with the popular will to have fundamental liberties and guarantees safeguarded at different interdependent levels that speak to each other.
