“Nada sobre nós, sem nós”: cooperação internacional e participação das pessoas com deficiência para a implementação de seus direitos humanos

Abstract

A Convenção sobre os Direitos das Pessoas com Deficiência das Nações Unidas considera a participação de movimentos sociais e organizações não governamentais como forma de proporcionar legitimidade às agendas internacionais. Esse propósito também orientou a criação do Comitê sobre os Direitos das Pessoas com Deficiência da ONU, que funciona como órgão de fiscalização do cumprimento da Convenção nos países signatários, bem como de processamento de denúncias individuais sobre supostas violações aos direitos humanos das pessoas com deficiência. A presente pesquisa teve como objetivo investigar como se deu a influência dos movimentos sociais de pessoas com deficiência nos organismos internacionais de proteção aos direitos humanos e na aplicação da CDPD no Brasil, tanto no momento anterior à elaboração da Convenção, quanto durante a atuação do Comitê sobre os Direitos das Pessoas com Deficiência da ONU, levando em consideração as experiências de movimentos sociais que passaram a buscar, no espaço público transnacional, novas redes de articulação política para a consolidação de marcos normativos e agendas de direitos humanos. Mais especificamente, foi analisado: 1- como se deu a participação de grupos de pessoas com deficiência na elaboração da CDPD; 2- como o Comitê da ONU preconiza a participação de organizações de pessoas com deficiência nos Estados-membros; 3 - como ocorreu a participação de movimentos de pessoas com deficiência no procedimento de avaliação da implementação da CDPD no Brasil. Esta análise documental foi elaborada para testar a hipótese de que o espaço público transnacional tem se tornado receptível para a participação de indivíduos, organizações e movimentos sociais, que proporciona legitimidade para a reivindicação por direitos protagonizada por estes grupos, de modo que foi utilizado o método hipotético-dedutivo para conduzir a pesquisa. Este estudo foi desenvolvido à luz da teoria da luta por reconhecimento de Axel Honneth, utilizado como referencial teórico principal desta pesquisa para fornecer elementos para apresentar uma reflexão crítica sobre os direitos humanos das pessoas com deficiência.

The United Nations Convention on the Rights of Persons with Disabilities considers the participation of social movements and non-governmental organizations as a means of providing legitimacy to international agendas. This purpose also guided the creation of the UN Committee on the Rights of Persons with Disabilities, which serves as a supervisory body for the implementation of the Convention in signatory countries, as well as for processing individual complaints about alleged violations of the human rights of persons with disabilities. The present research aimed to investigate the impact of social movements of persons with disabilities on international human rights protection bodies and the application of the CRPD in Brazil, both prior to the elaboration of the Convention and during the operation of the UN Committee on the Rights of Persons with Disabilities. This considers the experiences of social movements that have sought, in the transnational public space, new networks of political articulation for the consolidation of normative frameworks and human rights agendas. More specifically, the following aspects were analyzed: 1 - how the participation of groups of persons with disabilities occurred in the elaboration of the CRPD; 2 - how the UN Committee observes the participation of organizations of persons with disabilities in member states; 3 - how the participation of movements of persons with disabilities occurred in the procedure for evaluating the implementation of the CRPD in Brazil. This documentary analysis was developed to test the hypothesis that the transnational public space has become receptive to the participation of individuals, organizations, and social movements, providing legitimacy to the rights claims advocated by these groups. The hypothetical-deductive method was used to conduct the research. This study was developed in light of Axel Honneth's theory of the struggle for recognition, used as the main theoretical framework for providing elements for a critical reflection on the human rights of persons with disabilities.
