dc.description.abstract | Esta pesquisa, em nível de doutoramento, investigou as Instituições Comunitárias de
Educação Superior (ICES) do Brasil. As ICES são baseadas em uma estruturação
jurídica e administrativa de governança corporativa e econômico-financeira especiais,
em face da sua função pública não estatal, combinadas com a finalidade não lucrativa
e o interesse coletivo dessas organizações que atuam, em regra, sob a tríade do
ensino e da extensão – estando a pesquisa obrigatória para as ICES classificadas
como Universidades – com vias de desempenhar sua atividade fim e a função social
objeto deste estudo, com incentivos do Estado relativo a imunidade de determinados
impostos sobre a renda e seu patrimônio. O objetivo geral desta tese foi investigar a
construção identitária das ICES no Brasil a partir de 2013, avaliando se há contribuição
para a efetivação do direito à educação e qual função social exerceriam.
Problematizou-se a compreensão da identidade das ICES como sistemas sociais e de
quais seriam as políticas institucionais e práticas acadêmico-administrativas
preponderantes adotadas para a ampliação de sua atuação no oferecimento de mais
oportunidades de desenvolvimento para os estudantes, a expansão da oferta de
vagas para além de seus limites regionais, a busca da qualidade na prestação de seus
serviços educacionais, em sinergia com a conceituação jurídica das ICES e as
políticas públicas relacionadas a essa modalidade de instituição de ES, em especial
as de financiamento estudantil. A pesquisa é bibliográfica e qualiquantitativa, com a
utilização de dados quantificáveis relacionados à ES, com a apreensão de
informações das bases dos INEP/MEC, a partir das quais se verificou as contribuições
das ICES para a ES brasileira entre 2013 e 2022, com a análise estatística descritiva
e de regressão. Analisando os principais pontos da Lei nº 12.881/2013, destaca-se o
viés de conexão com as demandas sociais e da atuação do Estado na educação,
estabelecendo uma sistemática legal de atuação conjunta, de fomento e
financiamento público para a atuação das ICES junto às comunidades. Nesse
contexto, a Constituição Federal, com o direito à educação, o reconhecimento das
ICES e a Lei específica que faculta a qualificação de entidade de interesse social e de
utilidade pública mediante o preenchimento dos respectivos requisitos legais, os quais
são esteios para a compreensão do alcance das ICES enquanto ofertantes de
serviços à população, proporcionais aos recursos obtidos do poder público, conforme
previsto em instrumento específico. Conclui-se com um panorama socioeconômico da
ES no Brasil a partir de 1988, mas com ênfase no período entre 2013 e 2022, das
principais políticas públicas educacionais implementadas pelas ICES em exercício da
função pública do Estado quanto à efetivação do direito fundamental à educação,
valorizando sua identidade enquanto ente público não estatal, para a consecução da
missão, metas e objetivos estratégicos de cada organização comunitária. Defendeu se, assim, que as ICES desempenham funções sociais que contribuem para a

dc.description.abstract | This doctoral-level investigation focused on Community Higher Education Institutions
(ICES) in Brazil. The ICES are based on a legal and administrative structure of special
corporate and economic-financial governance, given their non-state public function,
combined with the non-profit nature and collective interest of these organizations that
generally operate under the triad of teaching and extension—with mandatory research
for ICES classified as Universities—with the aim of fulfilling their core activity and the
social function studied in this research, supported by State incentives related to tax
immunity on income and assets. The general objective of this thesis was to investigate
the identity construction of ICES in Brazil from 2013, assessing whether there is a
contribution to the realization of the right to education and what social function they
would perform. The understanding of the identity of ICES as social systems was
problematized, along with the examination of institutional policies and academic administrative practices adopted to expand their role in providing more development
opportunities for students, expanding the offering of seats beyond their regional limits,
and seeking quality in the provision of their educational services, in synergy with the
legal conceptualization of ICES and public policies related to this type of HEI,
especially student financing policies. The research is bibliographic and
qualiquantitative, using quantifiable data related to HE, with the retrieval of information
from INEP/MEC databases, analyzing the contributions of ICES to Brazilian HE
between 2013 and 2022 through descriptive and regression statistical analysis.
Highlighting key points of Law No. 12,881/2013, the connection with social demands
and the State's role in education is emphasized, establishing a legal framework for joint
action, promotion, and public funding for ICES to operate within communities. In this
context, the Federal Constitution, with the right to education, the recognition of ICES,
and the specific law that allows for qualification as a social interest entity and public
utility by meeting legal requirements, are foundational for understanding the reach of
ICES as providers of services to the population, proportional to resources obtained
from the public sector, as stipulated in a specific instrument. The conclusion provides
a socio-economic overview of HE in Brazil from 1988, with an emphasis on the period
between 2013 and 2022, highlighting the main educational public policies implemented
by ICES in the exercise of the State's public function regarding the realization of the
fundamental right to education, valuing their identity as non-state public entities to
achieve the mission, goals, and strategic objectives of each community organization.
It is argued that ICES perform social functions that contribute to the implementation of
