Abstract

O presente artigo trata do estudo da obra: De Legibus et Deo Legislatore, de Francisco de Suárez. Grande autor do chamado Século de Ouro da Escola Ibérica. Verificaremos a compreensão da lei em sua essência, a sua promulgação justa, seu ordenamento e sua gradação em lei natural e lei humana. Francisco Suárez ainda sustenta a lei como Regra Moral Necessária. Seguindo a linha Tomista, Francisco Suárez inova na concepção da lei como oriunda da ação da vontade. Aprofundando justamente a ação operativa da norma jurídica.

This paper deals with the study of the work: De Deo et Legibus Legislatore, by Francisco Suarez. Great author of so-called Golden Age of the Iberian School. We will check the understanding of the law in its essence, its just promulgation, its organization and its gradation in natural law and human law. Francisco Suárez also maintains the law as Required Moral Rule. Following the Thomistic line, Francisco Suárez innovates in the design of the law as coming from the action of the will. Just deepening the operative action of the rule of law.
