A proteção das pessoas transgêneras no sistema interamericano de direitos humanos

Abstract

A presente pesquisa tem como intuito averiguar as violências que a população transgênera sofre na esfera regional interamericana, especialmente no Brasil, e observar qual é o conteúdo das normas jurídicas que protegem tais indivíduos no Sistema Interamericano de Direitos Humanos, tendo em vista que o continente americano é o responsável pelo maior número de assassinatos dessa população. Para isso, buscou-se analisar documentos normativos do Sistema Interamericano de Direitos Humanos e manifestações da Comissão Interamericana de Direitos Humanos em que o Brasil cometeu atos de transfobia, já que o país é o líder mundial em assassinatos de indivíduos trans, além de verificar artigos científicos e livros sofre o tema. Dito isso, foi possível concluir que o Sistema Interamericano de Direitos Humanos possui diversas normas protetivas a transgêneros e, mesmo não tendo um tratado específico sobre o tema, há uma preocupação com a temática. Além disso, foi possível observar que, com a omissão do Poder Legislativo, o Poder Judiciário, em especial o brasileiro com o Supremo Tribunal Federal, é muito importante para a afirmação dos direitos das pessoas trans.

The present research aims to investigate the violence that the transgender population suffers in the inter-American regional sphere, especially in Brazil, and to observe what is the content of the legal norms that protect such individuals in the Inter-American System of Human Rights, considering that the American continent is responsible for the highest number of murders of this population. For this, we sought to analyze normative documents of the Inter-American System of Human Rights and manifestations of the Inter-American Commission on Human Rights in which Brazil committed acts of transphobia, since the country is the world leader in murders, in addition to verifying scientific articles and books suffers the theme. A documentary, normative and jurisprudential research, within the scope of inter-American international law and Brazilian law and based on the bibliographic review method, based on the observation of scientific articles and books. With this, it was possible to conclude that the Inter-American Human Rights System has several protective norms for transgenders and, even without having a specific treaty on the subject, there is a concern with the theme. In addition, it was possible to observe that, with the omission of the Legislative Power, the Judiciary, especially the Brazilian one with the Federal Supreme Court, is very important for the affirmation of the rights of transgender people.
