A Religiosidade do Estado Laico e a Dessacralização da Igreja: Uma Análise a partir da Obra “Secular Religion” de Hans Kelsen

Abstract

A presente pesquisa teve por objetivo analisar possíveis relações indiretas entre o Estado laico e a Igreja tendo como base de análise a obra “Secular Religion: A Polemic Against the Misinterpretation of Modern Social Philosophy, Science and Politics as 'new Religions'”, do jurista Hans Kelsen, trabalho pouco conhecido no Brasil, inclusive na área de Ciências da Religião. Nessa obra, Kelsen aborda as principais teorias da cultura do século XX em simetria com as filosóficas, sociológicas e com ideologias políticas e sua ligação com a teologia. Com isso, abordamos a secularização, atentos, também, ao contexto dos estudos weberianos sobre o termo. No âmbito da teologia política, discutimos o decisionismo que surge das relações do Estado laico com a Igreja (institucional e sacra), compreendendo o conceito de dessacralização. O método utilizado foi o bibliográfico, realizado por uma leitura imanente da obra referencial desta investigação. Abordamos o seguinte problema, questão de fundo da obra de Kelsen, objeto desta pesquisa: uma vez que a religião faz parte do construto cultural da humanidade, qual deve ser o lugar da religiosidade dentro de um Estado laico? Como objetivos específicos, procuramos saber se é possível, no ou a partir do trabalho do juspositivista, conceber-se uma religiosidade em um Estado laico e, ainda, entender se e como a Igreja participa dessa religiosidade. Enquanto resultado da pesquisa, a compreensão da dimensão do decisionismo em Kelsen trouxe diversas chaves, dentre elas um tipo de entendimento sobre o processo de dessacralização da Igreja enquanto via legitima ou não de acesso ao poder de decisão, que fere ou não a laicidade do Estado.

The present research aims to analyze possible indirect relations between the secular State and the Church based on the work "Secular Religion: A Polemic Against the Misinterpretation of Modern Social Philosophy, Science and Politics as 'new Religions'", by the jurist Hans Kelsen, a work little known in Brazil, including in the area of Religious Sciences. In this work, Kelsen addresses the main theories of twentieth-century culture in symmetry with philosophical, sociological, and political ideologies and their connection with theology. With this, we address secularization, also paying attention to the context of Weberian studies on the term. In the context of political theology, we discuss the decisionism that arises from the relations of the secular State with the Church (institutional and sacred), understanding the concept of desacralization. The method used be the bibliographic, so the immanent reading of the referential work of this research be carried out. We address the following problem, a fundamental question of Kelsen's work, object of this research: since religion is part of the cultural construct of humanity, what should be the place of religiosity within a secular State? As specific objectives, we try to know if it is possible, in or from the work of the juspositivist, to conceive a religiosity in a secular State and, also, to understand if and how the Church participates in this religiosity. As a result of the research, the understanding of the dimension of decisionism in Kelsen bring several keys, among them a type of understanding about the process of desacralization of the Church as a legitimate or not way of access to decisionmaking power, which hurts or not the secularity of the State.
