Violência contra a mulher na agenda interamericana de direitos humanos e possibilidades de impactos no Brasil

Abstract

A presente dissertação tem como tema central a violência contra a mulher na agenda interamericana de direitos humanos e as possibilidades de impactos no Brasil. Como objetivo principal, partindo dos tratados interamericanos, das recomendações da Comissão Interamericana de Direitos Humanos(CIDH), da jurisprudência da Corte Interamericana de Direitos Humanos (Corte IDH), dos programas/planos de trabalho e planos estratégicos produzidos pela Comissão Interamericana de Mulheres (CIM) e Mecanismo de Acompanhamento da Convenção de Belém do Pará (MESECVI), avaliamos se é possível afirmar que existem agendas interamericanas sobre violência contra a mulher. Temos como hipótese que a existência de tratados interamericanos específicos, recomendações da CIDH, programas/planos de trabalho e planos estratégicos dos organismos da OEA, bem como decisões da Corte Interamericana sobre violência contra a mulher, que buscam permanente conexão com as demandas dos Estados, dos movimentos sociais e de outros atores internacionais, nos permite afirmar a existência dessas agendas. Considerando a vinculação do Brasil ao Sistema Interamericano e as regras internas previstas na Constituição e na jurisprudência do Supremo Tribunal Federal a respeito da força normativa dos tratados e das orientações dos organismos internacionais de direitos humanos, também demonstramos como essas agendas podem impactar internamente o Brasil e como o descumprimento dessas agendas consubstanciam atos que não apenas violam os compromissos internacionais assumidos pelo país e o ordenamento jurídico vigente, como tambémcriam recursos desnecessários que acabam revitimizando as mulheres vítimas de violência.

This dissertation has as its central theme the violence against women in the inter-American human rights agenda and the possibilities of impacts in Brazil. As a main objective, based on the Inter- American treaties, the recommendations and guidelines ofthe Inter-American Commission on Human Rights (IACHR), the jurisprudence of the Inter-American Court of Human Rights (Inter- American Court), the programs/work plans and strategic plans produced by the InterAmerican Commission of Women (CIM) and Mechanism of the Convention of Belém do Pará (MESECVI), we evaluated whether it is possible to affirm that there are Inter-American agendas on violence against women. We hypothesize that the existence ofspecific Inter-American treaties, recommendations of the IACHR, programs/work plans and strategic plans of the OAS agencies, as well as decisions of the Inter-American Court on violence against women, which seek permanent connection with the demands of the states, from social movements and other international players, allow us to affirm the existence of these agendas. Considering Brazil's link to the Inter-American System and the internal rules provided for in the Constitution and the jurisprudence of the Supreme Court regarding the normative force of treaties and the guidelines of international human rights bodies, we also demonstrate how these agendas can impact Brazil internally and how the non-compliance with these agendas embody acts which not only violate the international commitments assumed by the country and the current legal system, but also create unnecessary resources that end up revictimizing women victims of violence.
