Além da revitimização: impactos de iniciativa que atua com perspectiva de gênero nas experiências de sobreviventes de tentativa de feminicídio no sistema de justiça criminal

Abstract

A violência de gênero não apenas representa uma violação dos direitos humanos, mas também se configura como um grave problema social. O feminicídio, como a manifestação mais extrema dessa violência, demanda um enfrentamento contra todas as formas de discriminação e violência direcionadas às mulheres, incluindo aquelas que são toleradas ou perpetradas pelo Estado. A fundamentação desta pesquisa reside na necessidade de explorar a interação das mulheres com o sistema de justiça criminal, desvendando as nuances que permeiam suas experiências. O foco não se limita apenas a revelar as diferentes facetas do sistema de justiça na perspectiva feminina, mas também visa entender como iniciativas que incorporam a perspectiva de gênero na sua atuação, podem influenciar o contexto do sistema de justiça criminal. O Projeto Re.nata se destaca como uma dessas iniciativas, oferecendo suporte tanto para vítimas diretas quanto indiretas de feminicídio. Nesse sentido, o objetivo deste estudo é compreender de que maneira esse projeto influencia a experiência das mulheres participantes. A fim de enfrentar a questão central e atingir os objetivos da pesquisa, este estudo se concentra em uma investigação empírica com uma abordagem qualitativa. A coleta de dados é realizada por meio de entrevistas semiestruturadas conduzidas com sobreviventes de tentativas de feminicídio. O intuito é escutar, através de seus próprios relatos, suas experiências pessoais, obtendo informações sobre a violência que enfrentaram, suas expectativas em relação ao sistema de justiça criminal e o tratamento recebido durante o processo penal, bem como ao longo de seu percurso no sistema. Quanto à análise dos dados, esta pesquisa emprega a técnica de análise de conteúdo proposta por Laurence Bardin, como um método sistemático para descrever os significados dos dados qualitativos coletados nas entrevistas. A aplicação desse método proporciona um processo científico estruturado, assegurando uma abordagem sistemática na análise dos dados. O referencial teórico desta pesquisa é a criminologia feminista, que se destaca como a primeira corrente criminológica a analisar a violência a partir de uma perspectiva de gênero. A criminologia feminista busca trazer para o centro do debate a experiência das mulheres como autoras e vítimas de violência, além de questionar as estruturas patriarcais que permeiam o sistema de justiça. Ao longo deste estudo o sistema de justiça criminal foi examinado criticamente, revelando uma tendência à revitimização das mulheres, perpetuando a violência institucionalizada. Por outro lado, com base nos resultados obtidos, concluímos que o Projeto Re.nata desempenha um papel relevante na transformação da experiência das mulheres. Ao fornecer suporte, a iniciativa não apenas mitiga muitas das limitações estruturais e sociais enfrentadas por essas vítimas, mas também promove uma conduta mais acolhedora e voltada às suas necessidades.

Gender-based violence not only represents a violation of human rights but also stands as a serious social issue. Femicide, as the most extreme manifestation of this violence, demands a fight against all forms of discrimination and violence directed at women, including those tolerated or perpetrated by the State. The basis of this research lies in the need to explore women's interaction with the criminal justice system, unveiling the nuances that permeate their experiences. The focus is not only to reveal the different facets of the justice system from a feminine perspective but also to understand how initiatives that incorporate a gender perspective in their actions can influence the context of the criminal justice system. The Re.nata Project stands out as one of these initiatives, offering support for both direct and indirect victims of femicide. Accordingly, the objective of this study is to understand how this project influences the experiences of participating women. In order to address the central issue and achieve the research objectives, this study focuses on empirical investigation with a qualitative approach. Data collection is carried out through semi-structured interviews conducted with survivors of femicide attempts. The aim is to listen, through their own accounts, to their personal experiences, obtaining information about the violence they faced, their expectations regarding the criminal justice system, and the treatment received during the criminal process, as well as throughout their journey within the system. Concerning data analysis, this research employs the content analysis technique proposed by Laurence Bardin, as a systematic method to describe the meanings of the qualitative data collected in the interviews. The application of this method provides a structured scientific process, ensuring a systematic approach to data analysis. The theoretical framework of this research is feminist criminology, which stands out as the first criminological current to analyze violence from a gender perspective. Feminist criminology seeks to bring women's experiences as authors and victims of violence to the forefront, as well as to question the patriarchal structures that permeate the justice system. Throughout this study, the criminal justice system was critically examined, revealing a tendency towards the revictimization of women, perpetuating institutionalized violence. On the other hand, based on the results obtained, we concluded that the Re.nata Project plays a relevant role in transforming women's experiences. By providing support, the initiative not only mitigates many of the structural and social limitations faced by these victims but also promotes a more welcoming conduct focused on their needs.
