Resumo
A pesquisa investiga, por meio de uma ontologia histórico-crítica, o papel da educação na construção social e a eficácia de movimentos sociais e de políticas públicas na garantia e conquista de direitos. Aborda conceitos como; consciência não-ingênua; interseccionalidade, dentre outros que permitem construir uma argumentação lógica e consistente a fim de comprovar as hipóteses formuladas por meio do método hipotético dedutivo, segundo o qual, a partir da delimitação de um problema de pesquisa, formulam se hipóteses que serão submetidas a testes de falseamento ao longo do trabalho, para que, ao final, obtenham-se os resultados esperados. Nesse contexto, a Constituição se torna um tipo de falácia, quando identificamos que, por mais que seja válida e esteja vigorando, não se efetiva, tornando-se meramente simbólica. Por fim, serão apresentados os resultados deste processo analítico nos direcionando a efetivação de todo o processo de resistência e luta por justiça social, fazendo da dignidade não mais um conceito puramente metafísico, mas resultado da concretização e garantia de direitos individuais e coletivos. A pesquisa sustenta a hipótese de que a Constituição é uma espécie de “falácia” formulada para tentar encobrir um Estado criado para excluir, uma vez que ela vigora, mas não se efetiva. Logo, indaga-se: como se pode encontrar vieses para driblar tal estrutura e exigir que a conclusão desse silogismo social não mais seja falaciosa? Os resultados alcançados pela pesquisa sugerem que, para que um povo se veja revestido de direitos, é preciso compreender que essa transformação será fruto de uma luta constante e conjunta, que tem início na garantia de uma educação emancipadora.
The research investigates, through historical-critical ontology, the role of education in social construction, and the effectiveness of social movements and public policies in securing and advancing rights. It addresses concepts such as non-naïve consciousness, intersectionality, among others, which enable the construction of a logical and consistent argumentation aimed at testing the hypotheses formulated through the hypothetical deductive method. According to this method, starting from the delimitation of a research problem, hypotheses are proposed and subsequently subjected to falsification tests throughout the study, to ultimately obtain the expected results. In this context, the Constitution becomes a type of fallacy, insofar as, although it remains valid and in force, it fails to materialize in practice, thereby assuming a merely symbolic character. Finally, the results of this analytical process will be presented, guiding us toward the realization of the entire process of resistance and the struggle for social justice—transforming dignity from a purely metaphysical concept into the tangible outcome of the realization and guarantee of individual and collective rights. The research supports the hypothesis that the Constitution functions as a kind of “fallacy” designed to conceal the exclusionary nature of the State—since it exists and operates yet fails to be effectively implemented. Thus, the study raises the question: how can one identify ways to circumvent such a structure and demand that the conclusion of this social syllogism cease to be fallacious? The findings suggest that for a person to be truly endowed with rights, it is essential to understand that such transformation can only result from a constant and collective struggle, one that begins with the assurance of an emancipatory education.
