Resumo
Esta pesquisa tem como ponto de partida levantamento preliminar realizado pela
Associação Brasileira de Jurimetria (ABJ), o qual identificou que os endereços das
partes (autores e réus) em processos judiciais cíveis na Comarca de São Paulo/SP
coincidem com os bairros de maior renda e/ou centrais da cidade. Locais periféricos
e de baixa renda, conforme apurado, estão distantes do Judiciário, em verdadeiro
blackout jurisdicional. Esses últimos são aqui tratados por CEPs esquecidos. Nesse
cenário, a presente pesquisa busca entender quais são os obstáculos que a
população residente nos CEPs esquecidos enfrenta para a concretização do direito
fundamental ao acesso à justiça. Pautando-se na definição trazida por Kazuo
Watanabe sobre o “acesso à ordem jurídica justa”, analisar-se-ão as ondas
renovatórias de Cappelletti e Garth, além de outros autores clássicos e
contemporâneos sobre o tema. O foco é a realidade social e as dificuldades
enfrentadas por esta parcela da população, no particular. Este estudo deve contribuir
com reflexões, sob diferente perspectiva, para implementação de políticas públicas
voltadas à democratização do direito fundamental ao acesso à ordem jurídica justa.
Para tanto, emprega-se o método de abordagem hipotético-dedutivo, métodos de
procedimento bibliográfico, histórico e monográfico.
The starting point of this research is a preliminary survey conducted by the Brazilian Association of Jurimetria (ABJ), which identified that the addresses of the parties (authors and defendants) in civil lawsuits in the District of São Paulo/SP coincide with the neighborhoods with higher income and/or central neighborhoods in the city. Peripheral and low-income places, as determined, are far from the judiciary, in true "judicial blackout". These last-mentioned locations are called here by “forgotten ZIP Codes”. In this scenario, this research seeks to understand the obstacles that the population residing in the forgotten ZIP Codes faces for the realization of the fundamental right to access to justice. Based on the definition brought by Kazuo Watanabe on "access to the just legal order", there will be analyzed the renewal waves of Cappelletti and Garth, as well as other classical and contemporary authors on the subject. The focus is on the social reality and the difficulties faced by this part of the population, in particular. This study should contribute with reflections, from a different perspective, to the implementation of public policies aimed at the democratization of the fundamental right to access to the just legal order. For this, the hypothetical deductive approach method, methods of bibliographic, historical and monographic procedure are used.
